‍END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“Agreement” or “EULA”) is a legal contract between Sresht Ayur Pte Ltd (“Sresht Ayur”, “we”, “us”, or “our”), a company incorporated in Singapore, and you (“User”, “you”, or “your”). It governs your use of the My Ayur App (the “App”), including any related services, content, features, or updates.

By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not install, use, or access the App.

1. License Grant

Subject to your compliance with this EULA and our Terms & Conditions:

  • We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App solely for your personal, non-commercial use on a supported device that you own or control.
  • You may not use the App for any commercial purpose unless we give you prior written permission.

2. Restrictions on Use

You agree not to:

  • Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to derive source code from the App, except as allowed by applicable law.
  • Rent, lease, sell, sublicense, transfer, or distribute the App or any portion of it.
  • Circumvent or disable any security or technical features of the App.
  • Use the App to transmit malicious code, spam, or harmful content.
  • Misuse health-related features by inputting false, misleading, or offensive data.
  • Violate any applicable laws, regulations, or third-party rights while using the App.

3. Ownership and Intellectual Property

  • The App and all related intellectual property rights, including trademarks, logos, content, and software, are the property of Sresht Ayur Pte Ltd or its licensors.
  • This EULA does not transfer ownership of the App to you. It only grants a limited license.

4. Updates and Modifications

  • We may provide updates, upgrades, bug fixes, or enhancements (“Updates”).
  • Updates may install automatically or may require your approval.
  • This EULA applies to all Updates unless we provide different terms with an Update.
  • We may modify or discontinue the App, or any part of it, at any time without liability.

5. Data Collection and Privacy

  • Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data.
  • By using the App, you consent to data collection and processing as described in the Privacy Policy.

6. Health Disclaimer

  • The App provides Ayurvedic insights, wellness recommendations, and dietary guidance for informational and educational purposes only.
  • The App does not provide medical advice, diagnosis, or treatment.
  • Always consult a qualified physician or healthcare provider before making changes to your health, diet, or lifestyle.
  • Your use of the App is at your own risk. Sresht Ayur is not responsible for health outcomes resulting from reliance on the App.

7. Termination

  • This EULA remains effective until terminated by you or by us.
  • You may terminate it at any time by uninstalling and ceasing to use the App.
  • We may terminate or suspend your license if you fail to comply with this EULA, our Terms & Conditions, or applicable laws.
  • Upon termination, you must immediately uninstall and destroy all copies of the App.

8. Limitation of Liability

  • To the fullest extent permitted by law, Sresht Ayur is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of the App.
  • Our total liability under this EULA will not exceed the amount you paid, if any, to use the App during the 12 months before the claim arose.

9. Indemnity

You agree to indemnify, defend, and hold harmless Sresht Ayur Pte Ltd, and our affiliates, officers, employees, and partners, from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising out of:

  • Your misuse of the App,
  • Your violation of this EULA or any applicable law, or
  • Any third-party claims resulting from your actions in the App.

10. Governing Law and Jurisdiction

  • This EULA is governed by the laws of Singapore, without regard to conflict of law rules.
  • For users in India, mandatory protections under India’s Digital Personal Data Protection Act, 2023 (DPDPA) also apply.
  • Any disputes will be subject to the exclusive jurisdiction of the courts of Singapore.

11. Entire Agreement

This EULA, together with our Terms & Conditions and Privacy Policy, is the entire agreement between you and Sresht Ayur regarding your use of the App and supersedes any prior or contemporaneous understandings.
